Please read these Terms and Conditions of Service carefully as they contain important and binding information on Users' rights and obligations.
By accessing or using the Website, including through mobile devices, tablets or others applications for fixed or mobile devices, you agree to comply with and be bound by these Terms and Terms of Service ("T&C").
7Sundays srl is a company governed by Italian law composed only of Italians, with its registered office in Milan ( "7Sundays" ), Via Bezzecca, 1 20135 Milan, registered in the Business Register of the Chamber of Commerce of Milan, n. REA MI-2536812, Tax Code 10505410968, who designed and manages the website www.7sundays.it ( "Website" ), also through applications for mobile devices, such as online platform for the dissemination of housing advertisements aimed at meeting demand directly and the offer.
In particular, the 7Sundays Website and applications allow owners ( "Owners" or "Host" ) of the accommodation made available through the Website ( "Real Estate" or "Accommodation" ) to publish advertisements and images relating to their properties so that users of the Website (hereinafter the "Guests" or "Guest" ) can view them, select them and, if necessary, book them for holidays and stays in short term ( "Reservations" ); in addition, guests will be able to purchase a series of ancillary services optional always viewable through the Website.
These T & Cs apply to and bind 7Sundays and the Owners, ancillary service providers, Guests, all generically also referred to as "Users".
Acceptance of these terms and conditions of service is essential to access the services offered by the platform. 7Sundays, if the User accepts these conditions of use, acts as the owner's representative, managing the exchange of information between the Owner and the Guest, receiving and communicating reservations and related confirmations, managing the payments made by the Guests to Owners and, once the service has been provided, by issuing the related invoices, where provided and authorized by the Owner. In any case, the decision relating to the actual taking charge of the Guests 'requests is left to the Owners' independent determination.
Users will therefore have two distinct contractual relationships:
the relationship with the Owner / Guest who will provide / book the accommodation;
the relationship with 7Sundays for the use of the platform and the management of reservations.
The Website aims to connect Guests with Owners. The role of 7Sundays is exclusively to create advertising spaces in which the Owners can publish advertisements and images relating to the Properties available to Guests; it remains completely unrelated to the contractual relationship between the Guests and the Owners ( "Guest / Owner Agreement" ), not being liable in any way for their actions or omissions. Furthermore, he does not assume the quality of real estate broker, nor of organizer or seller of travel packages under Directive (EU) 2015/2302.
7Sundays reserves the right to modify and update these T & Cs at any time, upon publication of the updated version on the Website.
By continuing to use the Website, Users expressly accept the T & Cs in force from time to time.
In particular, it is specified that the applicable terms of the Guest / Owner Agreement relating to Reservations will be those in force at the time of each Reservation.
7Sundays does not own, manage, or have any rights with respect to the Accommodations that Owners post on the Website ( "Listings" ) and is not responsible for, warranties or representations in relation to any inaccuracy of the Listings or the lack of suitability or safety of the premises for the proposed use. The Owner is solely responsible for the Announcement and the accuracy of what is indicated, taking care that the Announcements are always updated and correct. Guests are advised, before booking, to make the necessary inquiries to ensure that the proposed accommodation meets their needs. However, it will be 7Sundays' responsibility to take note of the comments received from the Guests, reserving the right to modify the Announcements or delete them if any inaccuracies or serious discrepancies with respect to what is declared by the Owner are found.
7Sundays does not carry out accurate checks on the Accommodations on the identity of the Owners or on the identity of the Guests, although it can carry out random checks or upon suitable reporting.
The Owner is required to pay the necessary diligence and attention before accepting any Booking.
The Owner is solely responsible for the decision to accept or reject Bookings. 7Sundays provides an introduction service and offers no guarantee as to the suitability of the Guest.
How to become a 7Sundays Member
To become a 7Sundays Member and thus be able to advertise or book accommodation through the Website as an Owner or Guest, you need to create an account.
You will be asked to provide some registration information: this information must be true and accurate. A confirmation email will be sent once the reference account is opened.
Only people over the age of 18 will be able to create an account and become a 7Sundays Member. Also, please do not create more than one account on the Website.
The username and password chosen during the account registration process are strictly confidential and are intended to protect Members' personal information.
Members undertake not to share their password with third parties, not to disclose it and to keep it safe.
7Sundays takes the content posted on the Website very carefully and all 7Sundays Members are required not to make any discriminatory statements and / or communications for any reason, nor to be offensive, abusive or defamatory. In the event of any discriminatory, offensive or defamatory behavior on the part of a Guest, 7Sundays will proceed to block the access and use of the Website services and to remove it from 7Sundays Members. 7 Sundays may also deny access to the Accommodation with cancellation of the Reservation. In this case, the Guest's Applicable Cancellation Policy will operate, which varies depending on the property booked and the policy chosen by the Owner when publishing the ad. The guest is requested to read it before booking.
In the event of discriminatory, offensive or defamatory behavior by an Owner towards a Guest, 7Sundays may remove the Advert published on the Website and the Reservation will be considered canceled by the Guest. In this case, the conditions of the Guest Refund Policy will apply.
7Sundays' decision on the application of the provisions is final and binding.
7Sundays Members who act as agents with or without representation of a Guest or Owner must have the power to sign and bind the Guest or Owner pursuant to these T&C., Which they undertake to make read and understood to their principals, assuming in any case any responsibility deriving from the lack of and / or incomplete reading and / or understanding.
Guests and Owners will be solely responsible for the actions or omissions committed by their agents or representatives, even if they act outside the powers received or in contrast with the limits of the same.
Reservation of Accommodation
Guests can use the Website to review the Announcements, check the availability of an accommodation and make a reservation request for the Accommodation ( "Reservation Request" ).
The Guest is then directed to a page where they review the Booking Request which specifies the details of the Booking. If they wish to proceed, the Guest confirms the Booking Request by entering the payment details, accepting the T & Cs and the Owner Applicable Cancellation Policy and, if applicable, the House Rules. In this way the Guest confirms the Booking Request.
By confirming the Reservation Request and providing his payment card details, the Guest agrees to stay in the Owner's Accommodation for the chosen period and at the accepted price, in accordance with the terms of the Guest / Owner Agreement. The price may also include the cost of additional services expressly indicated therein, which may be mandatory (eg cleaning cost) or optional. By submitting a Booking Request, the Guest agrees to be bound by these T & Cs, the Guest / Owner Agreement, the Owner Applicable Cancellation Policy and the House Rules. In addition, he confirms that he has carefully examined the Accommodation Listing and that the Accommodation is suitable for your specific needs.
The Guest will receive from 7Sundays on behalf of the Owner a Booking Confirmation within a few minutes and, in any case, within 24 hours of the Booking Request or a notification that the Booking has been rejected.
A Reservation is considered confirmed on the date and time the Reservation Confirmation is sent to the Guest.
At the same time as sending the Booking Confirmation, the amount indicated in the Booking Request and paid by the Guest will be collected by 7Sundays.
The Guest will be responsible for all taxes deriving from the use of the Accommodation, including any tourist or tourist tax. Normally specified at the time of booking and c. The Guests agree that if the taxes collected by us through the booking and the online payment to make a Booking are not sufficient to fully extinguish the Guest's tax obligation for a Booking, the latter will pay the difference to 7Sundays. due.
Once the Booking is confirmed, it becomes personal, exclusive and non-transferable for the Guest without the prior consent of the Owner. If the Guest decides to purchase or delete additional services, they must contact 7Sundays to make the request in compliance with the notice period indicated in the Booking Request.
If the Guest does not receive Booking Confirmation or notification that the Booking has been rejected within 24 hours, it is necessary to report it by calling +39 0283471145 or by sending an email to firstname.lastname@example.org.
Guests and Conduct
The Guest and the Owner will be required to comply with the Guest / Owner Agreement entered into in connection with the Reservation.
The maximum number of people and pets allowed in the Accommodation is established in the Announcement. In case of violation, the Cancellation and Refunds clause will apply.
Guests agree with the Owner:
to leave the Accommodation no later than the check-out time specified by the Owner in the Announcement or at any other time agreed by mutual agreement between the Guest and the Owner;
that if they remain beyond the agreed check-out time without the consent of the Owner, they will be considered illegal occupants and the Owner himself will be authorized to request their forced release in accordance with the applicable law;
for each hour of delay in returning the Property, in any case, they will be required to pay the Owner an amount equal to 20% of the amount foreseen in the Reservation, authorizing 7Sundays from now on to debit this sum on the Guest's payment card . This sum will be added to any cost or expense (including legal assistance) incurred by the Owner and / or by 7Sundays on behalf of the Owner to collect the payment or to obtain the release of the Accommodation, which the Guest accepts from now on. they will also be charged to your payment card.
if the Guest requests the Owner to engage a third party for the provision of goods or services, the Guest acknowledges and agrees that the provision of such goods or services will be subject to the terms and conditions of such third parties, excluding any liability of the Owner. and / or 7Sundays.
Costs, commissions and payments
All payments will be made in Euros, possibly at the conversion rate at the time the Reservation is made.
Types of costs due:
"Accommodation Costs" : these are the costs collected by 7Sundays from the Guests on behalf of the Owners for the stay in the Accommodation and for any additional services purchased by the Guest.
"Security Deposit" : this is the amount indicated in the Accommodation Announcement in order to deal with any damage (other than those attributable to reasonable wear and tear) caused to the Accommodation and its contents during the stay of the Guest. The Guest expressly authorizes 7Sundays to collect the aforementioned amount on his or her payment card on behalf of the Owner. In the event of damage exceeding the security deposit, the Guest will still be liable to the Owner for the full amount of the damage and the balance difference will be paid by the Guest directly to the Owner. The Security Deposit, in the absence of damage, will be returned to the User within 48 hours of returning the Accommodation. Within the same term, damages will be charged, with simultaneous communication to the Guest of the declarations of the Owner and the consequent withholding of the Security Deposit.
The security deposit will also be retained in the event of theft of movable property contained in the accommodation, as well as in the event of release in particularly dirty or degraded conditions, which require extraordinary cleaning to be restored.
"Service Fee" : this is the fee requested by 7Sundays from Guests for booking the Accommodation and any additional services found on the site and for the support provided in managing the relationship with the Owner. It is between 10% and 20% of the total Housing Costs, plus VAT. It also applies to the Security Deposit if it is retained as provided in letters b) and c) above, to the extent of 3% of the amount withheld, plus VAT.
Once the Booking Confirmation has been sent, it is non-refundable, except in the limited cases set forth in the Guest Refund Policy and / or the Owner's Applicable Cancellation Policy.
"Control Costs" : this is the amount charged to the Owner in the following cases:
if the Owner provides incomplete or incorrect information before or during the inspection of the Accommodation: EUR 150 for the inspection and EUR 100 for the advertisement text
if the Owner asks to change the agreed time slot for the control with less than 24 hours notice: 50 EUR
if, once the check has been carried out, the Owner revokes the posting of the announcement of their Accommodation on the website: reimbursement of EUR 150 for the inspection and EUR 100 for the text of the Announcement
Guests required to provide 7 Sundays with payment card details must be card holders or expressly and legally authorized by the cardholder to use the card for the intended purpose.
The Owner gives 7Sundays a mandate for collection so that it collects on its behalf all the amounts owed by the Guest under the Reservation made through the website and at the same time authorizes 7Sundays to make refunds on its behalf in favor of the Guest should the hypotheses arise. contractually provided for reimbursement, also pursuant to these T & Cs, in relation to the same Booking.
Guests acknowledge and accept the intervention of 7Sundays as the agent for collection on behalf of the Owner.
Guests entitled to a refund under the Owner's Applicable Cancellation Policy will receive a refund from 7Sundays within 14 days of receiving notification of cancellation provided the Reservation has been fully paid for.
In any case, neither 7Sundays nor the Owner can be held responsible for any additional costs or expenses incurred by the Guest in connection with a canceled Reservation (including travel costs or event tickets).
It is in the Guest's interest to take out suitable travel insurance that will hold him harmless from cancellation and / or cancellation charges and costs.
It is expressly forbidden for the Owner to request and / or collect any payment from the Guest outside the Website and 7Sundays.
In any case 7Sundays is not liable towards the Guest (or the Owner) in relation to any payment made by the Guest outside the Website.
Cancellation by the Guest
The Guest is entitled to cancel a Reservation at any time according to the Cancellation Policy provided by the Owner to be applied to the Reservation ("Owner Applicable Cancellation Policy"), as specified in the Accommodation Listing. The Guest acknowledges and accepts that refunds will be available on the terms and conditions set forth in the aforementioned Cancellation Policy.
To make a cancellation, the Guest must send an e-mail to email@example.com, clearly indicating the intention to cancel the Reservation. The date and time of receipt of the e-mail will be equivalent to those of cancellation ("Date and time of cancellation"). 7Sundays will send the cancellation notification to the Owner within 1 business day of receiving the Guest's email.
If the Guest arrives at check-in with a greater number of guests or animals than those declared at the time of Booking or in violation of the House Rules set out in the Listing, the Owner will have the right to refuse access to the Accommodation: in this case the cancellation by the Guest on the day of check-in is deemed to have taken place and the Applicable Cancellation Policy of the Owner will apply for the purposes of the refund. The owner is required to notify 7Sundays of the refusal within one hour, by e-mail.
If the Guest does not show up for check-in within 24 hours from the time indicated in the Announcement, in the absence of a different agreement with the Owner, the hypothesis of cancellation by the Guest will be considered and the Applicable Owner Cancellation.
If the Guest is late to check-in, they must notify the Owner in advance via the 7Sundays Website or call prior to check-in to arrange a new check-in time with the Owner. The Owner and the Guest will work with each other to establish a new reasonably acceptable check-in time.
In the event of a cancellation not attributable to the Guest for having done everything possible to collaborate with the Owner to agree on a reasonably alternative check-in time, a refund of the amount paid at the time of Booking will be due, provided that it is requested by the 'Guest within 24 hours of cancellation, meaning this occurred on the day and time of the scheduled check-in.
It will be the responsibility of 7Sundays to inform the Owner of the refund request received from the Guest and, where possible, to propose to the latter the transfer of the Reservation to another available Accommodation that can be considered equivalent, with an indication of the related costs.
Disputes that occur during the Guest's stay
If during the Guest's stay there are problems with the Accommodation and / or the appliances or other movable property that are in the Accommodation, the Guest must report such problems to the Owner immediately and in any case within 24 hours of discovery. . The Owner is obliged to take action to eliminate the problem within 24 hours of reporting. If it is not possible to remedy within the aforementioned term, the Owner must communicate with the Guest to agree on a solution within a reasonable time accepted by the Guest.
Any complaint by an Owner in relation to visible damage or theft found in the Accommodation or any other problem related to the stay must be communicated to the Guest and 7Sundays within 48 hours of the Guest's check-out. The expiration of this term in the absence of force majeure or impediments objectively not attributable to the Owner entails forfeiture of any request for compensation.
Any complaint by a Guest in relation to the Security Deposit must be communicated to the Owner and 7Sundays within 48 hours of the expiry of the term referred to in the previous point.
The Guest and the Owner agree to act in good faith and to cooperate with each other to resolve any dispute.
7Sundays, if informed by the Owner and / or the Guest, will collaborate and will endeavor to mediate between the parties, so that they can settle the dispute amicably.
Cancellation of Membership of the 7Sundays website - Conditions applicable to Users
The User has the right to cancel their registration and therefore their membership of the site at any time by sending an email to firstname.lastname@example.org.
7Sundays has the right to suspend or terminate the registration and therefore the adhesion to the 7Sundays site, upon communication by email, in the event of a serious violation of these T & Cs. In this case, the suspension or cancellation will not give the right to any refund, even if the User has already booked or paid for an Accommodation and/or an additional service.
7Sundays is the owner of all rights, including intellectual property rights, relating to the Website and the content made available through the Website and / or on social media, including all text and images, photographs and descriptions relating to Accommodations.
Users, by accepting these T & Cs, receive a non-transferable and non-exclusive license to use the Website in order to view and, where appropriate, book the Accommodations and related services during the registration period as a Member.
Any other use, including that of photographs, is prohibited, as all rights reserved in favor of 7Sundays.
In particular, by way of example only, it is expressly forbidden for Members:
copy any element of the Website;
make changes or changes to all or part of the Website;
use any element of the Website or digital content in an unlawful manner or in any way that is inconsistent with these T & Cs, or act in a fraudulent or malicious manner, for example, by hacking or entering malicious code, including viruses or harmful data, trojans, worms, or other harmful material;
attempt to gain unauthorized access to the Website, servers or computers or databases connected to the Website;
publish on the Website any defamatory, contrary to morality, deceptive, discriminatory or offensive content;
disclose sensitive or personal information about another person;
falsify your identity; (h) use the Website to manage or complete a booking outside the Website;
carry out advertising activities without the express consent of 7Sundays;
use any data mining, data collection or data extraction tool to collect usernames, email addresses or other data from the Website for any purpose;
violate the intellectual property rights of 7Sundays or third parties in connection with the use of the Website.
In any case 7Sundays is not responsible for the functionalities or contents present or made available by third party applications, services or links.
7Sundays will endeavor to make the Website always available for the entire daily period, while remaining unrelated to any failure to perform or delay in the execution of any of the obligations deriving from these T&C caused by actions or events of third parties or however beyond its reasonable control, including failures in public or private telecommunications networks. 7Sundays has the right to modify the Website at its discretion without notice.
In using the site functions that allow you to express an evaluation and / or a review for the functionality of the site and for the services offered, Users accept and undertake to observe the following rules:
the review represents an individual and personal evaluation of the reviewer, which must be correct, truthful and factual;
the evaluation and / or review must not be offensive, defamatory or discriminatory;
7Sundays has the right to use this review;
7Sundays has the right to attribute the review to the username;
7Sundays has the right to remove the review at any time and at its sole discretion.
7Sundays is not responsible for the content of reviews that meet the criteria referred to in letters a) and b).
The use of the Website implies the consent to this treatment.
7Sundays will use the email address provided during registration for any communication to Users.
If one or more provisions of these T & Cs are deemed illegal or unenforceable, the remaining ones will remain in full force and effect.
